All marital property such as real estate, pension plans, stocks, 401(k) savings accounts and inheritances are considered marital property in Massachusetts and will be divided equitably upon divorce. However, equitably doesn’t necessarily mean a 50-50 split.

If one spouse has substantially more earning power than the other, the spouse with less money may receive a greater share of the marital property. Spouses may also negotiate a higher share of community property in exchange for alimony.
